These Terms and Conditions apply to services provided by Elysium Business Systems Pty Ltd trading as Bell Curve Solutions (“Bell Curve Solutions”, “we”, “our”, “us”).

Bell Curve Media monthly subscription services

By engaging our services or subscribing to Bell Curve Media, you acknowledge that you have read and agree to be bound by these Terms and Conditions.

General Terms​
The following terms apply specifically to ServiceM8 consulting and implementation services.
​
1.1. Services Provided
Bell Curve Solutions offers tailored business solutions, including:

ServiceM8 setup and consulting

Business analysis and process optimisation
-
Training, troubleshooting, and ongoing support
-
Additional custom services as requested

1.2 Client Responsibilities
-
Provide accurate information and necessary access to systems or accounts.
-
Ensure that your business complies with relevant laws and regulations.

Be available for scheduled meetings or training sessions as agreed upon.
​
1.3 Payment Terms
-
All services are invoiced according to the agreed rates or packages.
-
Payments are due within 7 days of the invoice date, unless otherwise specified.

Late payments may incur a late fee of 2% per month.
-
We reserve the right to suspend services for overdue payments.

1.4 Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information shared during the course of the engagement. This includes client data, business processes, and any confidential information shared by either party.

1.5 Intellectual Property

All materials, tools, processes, and software developed by Bell Curve Solutions are the intellectual property of Bell Curve Solutions unless otherwise agreed.

Any client-specific custom solutions may be subject to separate intellectual property agreements.

Bell Curve Solutions may display created work in portfolios, case studies, or marketing materials.

1.6 Limitation of Liability

Bell Curve Solutions will not be held liable for any damages, losses, or costs incurred as a result of using our services, except for those directly arising from our gross negligence or willful misconduct.

We are not responsible for any disruptions to your business due to external factors beyond our control.

1.7 Service Availability

We strive to provide services in a timely manner but cannot guarantee the availability or performance of our services at all times.

Services may be temporarily unavailable due to system maintenance, updates, or force majeure events.

1.8 Termination of Services
-
Either party may terminate the agreement with written notice if the terms are not being met.
-
Upon termination, any outstanding invoices will be due immediately, and access to services will be revoked.

1.9 Refunds and Cancellations
-
Refunds for services are not provided unless specifically agreed upon in writing prior to service delivery.

Coaching or consulting sessions may be rescheduled with at least 24 hours notice at no charge.

Cancellations or rescheduling requests made within 24 hours of the scheduled session may incur a cancellation fee of up to 50% of the session fee.
-
Failure to attend a scheduled session without notice may result in the full session fee being charged.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies available under Australian Consumer Law.

1.10 Governing Law
This Agreement is governed by the laws of Australia, and any disputes will be resolved in the jurisdiction of Australia.

Bell Curve Media Subscription Terms
The following terms apply specifically to Bell Curve Media monthly subscription services.

2.1 Subscription Services
Bell Curve Media provides social media content and management services including:

Social media content creation
-
Content scheduling and posting
-
Social media management
-
Content planning and strategy support
Services delivered each month will depend on the subscription plan selected.

2.2 Subscription Billing
Bell Curve Media subscriptions are billed monthly in advance.

The first payment will be processed at the time the client subscribes. Billing will automatically recur on the same date each month corresponding with the original subscription start date, unless the subscription is cancelled.

By subscribing, the client authorises Bell Curve Solutions to charge the nominated payment method each billing cycle.
All pricing is listed in Australian Dollars (AUD).

2.3 Service Commencement
Bell Curve Media subscription services will commence once the client’s subscription has been successfully activated and payment has been received.
Services will continue on a monthly basis while the subscription remains active and payments remain up to date.
​
2.4 Content Approval
Where content approval is required, clients must review and approve content within 7 business days.
If approval is not received within this timeframe, Bell Curve Media may:

Proceed with posting the content as scheduled, or
-
Move the content to the next available posting schedule.

2.5 Scope of Services
Each subscription plan includes a defined scope of services.
Requests outside the scope of the selected plan may include:

Additional content creation
-
Additional social media platforms
-
Additional revisions
-
Additional consulting or strategy sessions.
Requests outside the plan may be declined or quoted separately.

2.6 Failed Payments
If a payment fails:
-
Bell Curve Solutions may attempt to reprocess the payment
-
Services may be paused until payment is successfully received
-
Repeated payment failures may result in cancellation of the subscription.
​
2.7 Suspension of Services
Bell Curve Media reserves the right to temporarily suspend services where required for operational or compliance reasons.
Services may be suspended in circumstances including, but not limited to:

Required account access or platform permissions are not provided
-
Required approvals or information are not received from the client
-
Payment for the subscription has failed or is overdue
-
A client’s social media account is restricted or suspended by the platform.
Services will resume once the relevant issue has been resolved.

2.8 Cancellation
Subscriptions may be cancelled at any time.
To avoid the next billing charge, cancellation must be requested 72hrs before the next billing date.
Services will continue until the end of the current paid billing period.

2.9 Refund Policy
Due to the nature of digital services and content creation, subscription payments are non-refundable.
Refunds will not be provided for:

Partial months
-
Unused services
-
Cancelled subscriptions.
Refunds may only be issued at the discretion of Bell Curve Solutions and in accordance with Australian Consumer Law.

2.10 Intellectual Property
All content created by Bell Curve Media remains the intellectual property of Bell Curve Solutions until payment has been received in full.
Once payment has been completed, clients receive a license to use the content for their business marketing purposes.
Bell Curve Solutions may display created work in portfolios, case studies, or marketing materials.

2.11 Platform Changes and Restrictions
Bell Curve Media is not responsible for changes to social media platforms including:

Algorithm updates
-
Policy changes
-
Account restrictions or suspensions.
If a client account is hacked, suspended, or restricted, Bell Curve Media may pause services until the issue has been resolved.

2.12 Client Content Responsibility
Clients are responsible for ensuring that materials supplied to Bell Curve Media are lawful and permitted for use.
Bell Curve Solutions is not responsible for legal issues arising from content supplied by the client.

Changes to Terms
Bell Curve Solutions reserves the right to modify these Terms and Conditions at any time. Any changes will be communicated to clients, and the updated terms will apply to all future engagements.
